“What should I do if I have been charged with a crime?”

 

If charged with a crime, a defendant should:

 

1) Retain Legal Representation: Seek the assistance of an experienced criminal defense attorney. This step is listed first because it is the most important. A qualified criminal defense attorney will know all subsequent steps that the client should follow.

2) Understand Charges: Learn about the charges and potential consequences to make informed decisions. Knowing with what you have been charged will help your lawyer make informed decisions on your behalf.

3) Remain Silent: Exercise the right to remain silent to avoid self-incrimination.
NEVER TALK ABOUT THE INCIDENT WITHOUT YOUR LAWYER BEING PRESENT WITH YOU. NEVER SPEAK WITH THE POLICE ABOUT THE INCIDENT WITHOUT YOUR LAWYER BEING PRESENT WITH YOU.

4) Cooperate with Attorney: Work closely with the attorney, providing all relevant information for a strong defense.

5) Bail Hearing: If applicable, attend the bail hearing to secure release from custody. I have contacts with quality and trustworthy bondsman to help with this step.

6) Evidence Gathering: Collect evidence that may support your defense, and share it with your attorney. This step should only occur after we have made a determination of exactly how we should proceed.

7) Court Appearances: Attend all court appearances as required, following legal advice.

8) Negotiate or Contest: Discuss potential plea deals with the attorney, weighing the pros and cons, or prepare for trial if contesting the charges. I will be able to explain the pros and cons of pursuing negotiations and how to direct this process to your benefit.

9) Know Rights: Understand constitutional rights, such as the right to a fair trial and the presumption of innocence.

10) Sentencing Considerations: If convicted, be aware of potential sentencing factors and work with the attorney on mitigation strategies.
